We have all heard the ongoing rumor that has been circulating our industry for the past year or so…

“There is a glut of foreclosed property that the banks are holding back and anytime soon we will see an avalanche of REOs hitting the market place when the second wave hits us”

You are probably inclined to believe this because it has been getting harder to buy at a decent discount from the MLS and it has been scarce in the Bulk REO arena as well.

Well, let me tell you that these rumors are false and they have been spun by brokers and pretend investors that are not active in the business. Or by “gurus” that are trying to sell you the next “silver bullet method” by preying on your fears of the Real Estate market.

The truth is that there is more demand than supply. The players that were sitting by the sidelines are stepping on to the field, as well as a hoard of hungry international investors and hedge funds.Bank-owned-REO-homesl

In fact, the latest sales numbers have been so great that they have surpassed the number of foreclosures currently hitting the market. To be honest, I am starting to believe that there is no glut of foreclosed homes at all.

That being said, it is true that there are a huge number of mortgage defaults and foreclosures that are still hanging. This is an astronomical number, but it does not mean that there are stacks of foreclosures sitting inactive in bank files all over the world and not being marketed to the masses.

Due to a ton of misleading information on and off line, a good number of investors out there believe that they can take down Bulk REO Tapes in CA, AZ and NY at .50 cents on the dollar.

Ladies and Gentlemen, please hear this… Those packages do NOT exist! Bank Tapes in those markets are going for .80 cents to PAR; and in some instances above market value.

That is not investing, that is speculating, and we all know there is no difference from doing this to taking your capital to Vegas and rolling it at the roulette wheel.

Banks are not stupid nor going broke, they are in fact very smart and very liquid. They are releasing their inventory in those states through Realtors and retail buyers via the MLS, online, and print media.

Our company buys Bulk REO Tapes and Non Performing Notes straight from banks and asset managers. We own and control the product; there are no brokers and no “daisy chains”. We even allow you to “cherry pick” from out tapes of REOs and NPNs, you can take down 1 house or the entire tape. This is very rare and hard to find!

Unfortunately, you can not say the same of most “companies” out there. All they are doing is misrepresenting product and trying to broker these tapes and participating in never ending daisy chains. There is no .30 on the dollar product unless you’re taking down huge multi million dollar tapes at the Buffett level.

Let’s get something straight to start with. There is NO HIDDEN or Shadow Inventory of Distressed Assets.

I know many of you keep hearing that the second wave of foreclosures is coming. You could be thinking that because you are having difficulty in obtaining large bulk reo tapes, that the Banks must be holding or hoarding houses back from the market or that perhaps they are about to flood the market with thousands of properties.

We’ve been hearing that from many people for over a year now. I have never bought into it, because as I have always stated, is that the market can handle more inventory than most would think There is so much pent up demand it’s crazy.

The assumption that I have never challenged, until now, is that these foreclosures EVEN EXIST! Take a look at the latest numbers crunched at Foreclosure Radar.

I don’t know how you can argue with the data, the sales volume has been so great it is outpacing the numbers of foreclosures hitting the market. We have been saying that for over a year!

It is important to point out that there are massive numbers of defaults and foreclosure sales that are “hung up”. It’s an absolutely huge number of houses, but still, there’s not one person I’ve spoke to that did not believe that there are masses of foreclosures post sale that were sitting inactive that are not even being placed on the market.

The crazy thing is that every investor buyer wants to believe that they can purchase bulk these single family residential (SFR) tapes in CA, NV, AZ at 50-70 cents on the dollar. These investors are so motivated at the prospect that they are willing to treasure hunt for inventory that does NOT exist.

The reality is that our company is calling the banks every single day and I can tell you from our experience that nothing exists in CA, AZ, NV in bulk SFR tapes at discount prices (we have strong relationships with almost all the mid sized institutions).

The banks at best only have 1-5 REO properties at a time and they are unloading those via Realtors and brokers at NO discount. Asset managers are telling us that most of their bank owned properties are actually selling at full market value without any need to discount! The markets are moving in these states!

The inventory in the Southwest has dried up and the demand is obviously heading east across the Midwest. I can tell you that demand FAR exceeds supply so we only expect bulk SFR tapes in the Midwest and east to last another 12-24 months. The inventory that is available will NEVER be cheaper than it is now.

I am sure many of you have seen large, pennies on the dollar California Single Family Residential “tapes” flying around the internet, but I can assure you that it is NOT authentic product.

Many buyers are frustrated that they can’t find anything and it’s simply because it’s GONE. Anyone telling you that they have 0M – B in bulk single family homes at thirty (30) cents on the dollar is a joker or a part of a daisy chain of jokers….

So, check out the bulk market for yourself – the implications are huge for savvy investors! The Midwest is a market we are promoting because of the stock availability at low prices. Investors who are waiting to buy may really, really miss the boat. Available inventory has never been sold at such low prices. Waiting may be harmful to your wealth!

GREAT ARTICLE Duncan! There has been a wave of interest in this for the longest time and I’ve always preached this same notion “Why would banks unload assests under value when they are selling at fair market value”, it just doesn’t make sense. Maybe smaller banks, but they’ve already been bought out by the bigger banks, and even if they haven’t been bought out or closed, they are going to scrape every penny out of the asset.

There is an old clich?hat goes along the lines of “what is old is new again.” This clich?like many clich? has a certain sense of truth to it. For example, remember in the old pirate movies where the hero would purchase things using gold coins? Well, that old school method of purchasing is back! No, you do not have to carry gold dablooms around in a sack as the whole process has been modernized. Now, thanks to an internet service called Egold the ability to make payments/receive payments in gold can be processed over the internet electronically. Yes, gold is back in a big way!

Bad Rap on Land Trusts

Land trusts have existed since the Roman times with their clearest history being from the time of King Henry VIII.  During that time people used land trusts to hide their ownership of land so they could avoid having to serve in the military or be burdened with ownership responsibility.

The land trust has a history of being a tool for some investors to use to their advantage with their own unethical ways of doing business.  The bad rap about land trusts is currently the number of investors who use them for their own “special” way of doing a short sale.

Real Estate Investors and Land Trusts

There are many advantages to using land trusts; they are an excellent way to hold property.  When structured correctly, a land trust can help the investor with any seasoning issue that may arise with purchasing a house from a private owner.  Unfortunately, this doesn’t work when purchasing bank-owned homes.

Some of the advantages of a land trust are:

Sales price of the property can be kept off the public records Judgments or liens against an individual are not a lien against property in the land trust Partners can easily continue a project if one dies or is divorced Interest can be transferred quickly without recording a deed, because beneficial interest is considered to be personal property; not real property. Negotiating a purchase or sale is easier when the trustee can be blamed Liability on financing can be limited to the assets of the trust

A land trust must be structured properly in order to be of benefit to the investor, for example, seasoning issues that have hindered many deals are not a problem.  There are perfectly legal techniques for structuring a land trust to work to the real estate investor’s advantage.

Real estate investors who will be working with land trusts should consult a well-qualified real estate attorney about the land trusts laws in their state.  Keep in mind that not all attorneys understand the workings of a land trust.
